MODEL PROTOCOL

On the Status of Partner of the Collective Security Treaty Organization

 

The Collective Security Treaty Organization and (name of a state or an international organization), hereinafter referred to as “the Parties”,

Intending to regulate legal relations arising from granting of the status of the Partner of the Collective Security Treaty Organization to (name of a state or an international organization) on the basis of a relevant request and the Decision of the CSTO Collective Security Council of (date),

Have agreed as follows:

1.      (Name of a state or an international organization) shall reaffirm its interest in cooperating with the CSTO in the following areas[1]*:

-        Foreign-policy coordination on international and regional security problems;

-        Crisis response;

-        Military cooperation;

-        Military and technical cooperation;

-        Military and economic interaction;

-        Peacekeeping;

-        Countering international terrorism and extremism;

-        Countering transnational organized crime, including the illegal production of and trafficking in narcotic drugs and psychotropic substances, as well as their precursors, weapons trafficking, and illegal migration;

-        Ensuring information security;

-        Emergency response;

-        Other.

2.      (Name of a state or an international organization) shall recognize the CSTO’s right to terminate the Protocol at the initiative of the CSTO in cases envisaged by the Regulation on the Status of Partner of the Collective Security Treaty Organization (hereinafter referred to as “the Regulation”).

The CSTO shall grant to (name of a state or an international organization) rights and powers set forth in the Regulation, including the right to a unilateral withdrawal of (name of a state or an international organization) from the Protocol.

3.      (Name of a state or an international organization) shall assume the obligations provided for in the Regulation, including compliance with the Rules of Procedure of the CSTO bodies concerning the CSTO Partner.

4.      The CSTO permanent working bodies, in coordination with the CSTO Permanent Council and (name of a state or an international organization), shall hold meetings and consultations at the appropriate level on issues of mutual interest to define and agree upon specific events.

Meetings and consultations in the format of “the CSTO Member States and (name of a state or an international organization)” or “a CSTO permanent working body and (name of a state or an international organization)” shall be held upon mutual agreement. An outcome protocol can be adopted and signed in an agreed manner.

Protocols of meetings and consultations shall be drafted in the Russian language with its copies sent by the CSTO Secretary General to the CSTO Member States.

5.      (Name of a state or an international organization) shall establish and maintain formal contact with the Organization via the CSTO permanent working bodies through its diplomatic and other missions.

6.      The Partner, if necessary, shall provide translation of documents and statements from the official language of the Partner into Russian and from Russian into the official language of the Partner.

7.      The Protocol shall not affect any rights and obligations of the Parties under international treaties to which they are parties.

The Protocol shall be an international treaty, enter into force from the date of its signing and be of unlimited duration.

Upon the mutual agreement of the Parties, this Protocol may be amended by signing an appropriate additional protocol entering into force from the date of its signing, with amendments being an integral part of the Protocol.

Signed at __________ on “___” __________ 20___ in two copies, each in the Russian and __________ languages, with both texts being equally authentic. Should any disagreements about the interpretation of the provisions of the Protocol arise, the Russian text shall be used.
